1. Agreement to Terms

By accessing or using ViralPulse (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. The Platform is operated from Canada.

2. Description of Service

ViralPulse is a TikTok viral video discovery and AI script generation platform for content creators. The Platform finds TikTok videos that statistically outperform in your niche, analyzes why they went viral, and generates personalized scripts in your voice style. Features include a discovery feed of outlier videos, voice profile building, AI-powered script generation, favorites management, and keyword tracking. Content analysis is based on publicly available TikTok data.

3. Eligibility

You must be at least 13 years old to use the Platform, consistent with TikTok’s own minimum age requirement. By creating an account, you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

4. Account Terms

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

You may delete your account at any time from your account settings. Account deletion is permanent and triggers removal of all associated data after a 90-day retention period.

5. Subscriptions and Payments

5.1 Plans and Pricing

ViralPulse offers three subscription tiers: Creator ($19/month), Pro ($49/month), and Agency ($99/month). There is no free tier or trial. Prices are in USD. We reserve the right to change pricing; existing subscriptions are not affected until renewal.

5.2 Payment Processing

Payments are processed securely by Stripe. We do not store your payment card details. By completing a purchase, you agree to Stripe’s terms of service.

5.3 Cancellation

You may cancel your subscription at any time. Access continues until the end of your current billing period. After that, your account is locked: you can still log in and view historical scripts, but cannot generate new scripts, browse the discovery feed, or add keywords.

5.4 Refunds

Cancel anytime, no questions asked. If you request a refund within your current billing period, we will process it via Stripe. No prorated refunds are given for partial months. Credits are non-transferable and non-refundable.

5.5 Upgrades and Downgrades

Upgrading mid-cycle gives you immediate access to the higher tier’s limits with prorated billing. Downgrading takes effect at the end of your current billing period.

6. Credits and Usage Limits

Each subscription tier includes a monthly allocation of script generation credits (Creator: 15, Pro: 50, Agency: unlimited). Each script generation costs 1 credit. Credits reset on your billing cycle date, not the calendar month. Unused credits do not roll over. When credits are exhausted, script generation is unavailable until your next billing cycle or until you upgrade.

Keyword and niche tracking limits vary by plan. Adding beyond your limit requires upgrading to a higher tier.

7. AI-Generated Content

Scripts generated by ViralPulse are created using AI (OpenAI GPT). You own the scripts you generate. ViralPulse claims no ownership over your generated content and is not liable for content you create, publish, or distribute based on generated scripts.

AI-generated scripts are provided as creative assistance. They may require editing before use. ViralPulse does not guarantee that generated scripts will produce specific results, engagement, or virality.

8. TikTok Data and Content Analysis

ViralPulse analyzes publicly available TikTok video data including view counts, engagement metrics, captions, and transcripts. This analysis is used to identify statistical outliers and generate insights about viral content patterns.

If you provide your TikTok username, we analyze your publicly available video content to build a voice profile of your speaking and writing style. This is entirely optional and requires your explicit consent during onboarding. You can remove your TikTok username and delete your voice profile at any time.

We display TikTok creator names, thumbnails, and view counts for analysis and commentary purposes. ViralPulse is not affiliated with or endorsed by TikTok or ByteDance.

9. Intellectual Property

9.1 Our Content

The Platform’s design, code, algorithms, outlier scoring methodology, and original content are owned by ViralPulse and protected by intellectual property laws.

9.2 Your Content

You retain ownership of all scripts you generate, all feedback you provide, and any content you create using the Platform. We may use anonymized, aggregated usage data to improve our algorithms.

10. Acceptable Use

You agree not to:

• Use automated tools to scrape, crawl, or bulk-download content from the Platform
• Attempt to gain unauthorized access to other users’ accounts or our systems
• Resell, redistribute, or white-label the Platform’s output as a competing service
• Use the Platform for any unlawful purpose or to generate content that is harmful, hateful, or violates others’ rights
• Circumvent usage limits, credit systems, or any security features of the Platform
• Exceed 5 script generation requests per minute (rate limit)

11. Disclaimers

11.1 No Guarantee of Results

ViralPulse provides tools for content discovery and script generation. We do not guarantee any specific views, engagement, followers, or viral outcomes. Results depend on your content execution, audience, timing, and factors outside our control.

11.2 “As Is” Service

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11.3 Third-Party Services

The Platform relies on third-party services including TikTok data providers, OpenAI, and Stripe. We are not responsible for the availability, accuracy, or terms of these services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ViralPulse and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Termination

We reserve the right to suspend or terminate your account for violation of these Terms. Upon termination, access to the Platform is revoked. Your data is retained for 90 days after account closure, then permanently deleted.

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Canada. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Canada.
